1. Overview & Legal Disclosure
MediSaver Medical Discount Card (“MediSaver,” “we,” “us,” or “our”) is a licensed medical discount plan organization (DPO) operating in accordance with Chapter 636, Part II of the Florida Statutes.
MediSaver is not health insurance and should not be used as a substitute for insurance. MediSaver does not make any payments to providers of medical services. Members are responsible for payment of all services rendered at the discounted rates arranged by MediSaver with participating providers.
Important:
- MediSaver is not a pharmacy benefit manager or a pharmacy discount card.
- Discounts are available only through participating providers and may vary by location, provider, or service.
- Providers are independent and not controlled by MediSaver.
2. Membership Eligibility & Enrollment
- Membership is open to individuals 18 years of age or older residing in the United States.
- Enrollment is completed when the applicant submits required information, agrees to these Terms & Conditions, and pays the applicable membership fee.
- The membership covers the individual and, if selected, additional members as defined in the chosen plan (1 member / 2 members / up to 5 members for family plans).
- Members must provide accurate and complete personal information, including name, address, date of birth, and contact details. MediSaver is not responsible for issues caused by incomplete or inaccurate information.
3. Membership Fees & Payment
- MediSaver may offer monthly or annual membership options. Current pricing is displayed on the website www.medisavercard.com.
- Fees are charged automatically based on the billing frequency selected at enrollment.
- MediSaver reserves the right to adjust membership fees with at least 30 days’ notice to members.
- All payments are processed through secure third-party processors (e.g., Stripe). MediSaver does not store credit card data directly.
- Membership will automatically renew unless canceled in accordance with Section 5.
4. Provider Network & Services
- Discounts are available exclusively through participating providers under contract with MediSaver.
- MediSaver cannot guarantee that a specific provider will remain in the network. Provider participation may change at any time without prior notice.
- Discounts vary by service, provider, and geographic location.
- MediSaver does not guarantee or warrant the quality of care or outcomes of services provided by independent providers.
- Members are responsible for paying providers directly at the time of service.
5. Cancellation & Refund Policy
- Members may cancel membership at any time through their member portal or by contacting MediSaver directly.
- If canceled within 30 days of enrollment, the member is entitled to a full refund of membership fees paid, less any nominal processing fee if applicable.
- After 30 days, cancellation will be effective at the end of the current billing cycle, and no further charges will occur.
- MediSaver reserves the right to cancel any membership in the event of nonpayment, fraud, or violation of these Terms.
6. Provider Payments & MediSaver Role
- MediSaver does not pay providers for services rendered. Members pay the negotiated discounted rate directly to the provider.
- MediSaver’s role is solely to provide access to a network of discounted medical services.
7. Fraud Prevention & Misuse
To protect the integrity of the program:
- MediSaver may suspend or terminate memberships if there is suspected fraud, misuse, or sharing of membership credentials.
- Members agree not to transfer or resell their membership benefits.
- Any falsified information may lead to immediate cancellation and referral to regulatory authorities.
8. Member Responsibilities
- Ensure personal and contact information is accurate and up to date.
- Present valid proof of membership at the time of service.
- Confirm provider participation prior to receiving services.
- Pay the discounted rate directly to the provider.
- Comply with provider office policies (e.g., appointment requirements, cancellation policies).
9. Marketing, Communication & Consent
- By enrolling, the member agrees to receive communications (email, SMS, mail) related to their membership, benefits, and partner offerings.
- Members may opt out of marketing communications at any time without affecting their membership status.
- MediSaver may partner with third parties (e.g., pharmacy discount cards, wellness services) to offer additional benefits.
10. Electronic Agreements & Notices
- By enrolling online, members electronically sign and agree to these Terms & Conditions and all future updates.
- All communications, including policy updates, may be provided electronically via email or through the member portal.
11. Privacy Policy & Data Use
- MediSaver collects limited personal information for the purpose of program administration, compliance, and communication.
- We will not sell, lease, or disclose personal data to third parties for unrelated marketing without consent.
- We may share de-identified, aggregated data with partners to improve services.
- MediSaver complies with applicable state and federal privacy laws.
12. Limitation of Liability
- MediSaver is not responsible for the actions or omissions of providers.
- MediSaver is not liable for indirect, incidental, consequential, punitive, or special damages of any kind, including medical outcomes, costs, or delays.
- Maximum liability to any member shall not exceed the total amount of membership fees paid in the preceding 12 months.
13. Dispute Resolution
- Any disputes arising out of or relating to this agreement shall be resolved through good faith negotiation followed by mediation.
- If mediation fails, binding arbitration shall be conducted in Miami-Dade County, Florida, in accordance with the rules of the American Arbitration Association.
- Members waive the right to participate in class or collective actions.
14. Governing Law
- These Terms are governed by and construed in accordance with the laws of the State of Florida.
- If any provision is deemed invalid or unenforceable, the remainder of the Terms will remain in full force and effect.
15. Modifications
- MediSaver reserves the right to modify these Terms & Conditions at any time.
- Members will be notified at least 30 days in advance of material changes.
- Continued use of the membership after notice constitutes acceptance of the revised terms.
16. Additional Legal Protections (Recommended Clauses Added)
- Force Majeure: MediSaver is not responsible for failure to perform obligations due to causes beyond its control (e.g., natural disasters, pandemics, governmental orders).
- Indemnification: Members agree to indemnify and hold MediSaver harmless against claims arising from misuse of membership or violation of these Terms.
- No Third-Party Beneficiaries: These Terms are intended solely for members and MediSaver. No third party has any right to enforce these terms.
- Integration Clause: This document, along with enrollment information, constitutes the entire agreement
Disclosure Policy:
“This discount plan is not insurance. The plan provides discounts at certain health care providers for medical services. The plan does not make payments directly to the providers of medical services. The plan member is obligated to pay for all health care services but will receive a discount from those health care providers who have contracted with the discount plan organization.”
